Commercial Leasing

Witten LLP provides a broad spectrum of services in the commercial leasing sector on behalf of both landlords and tenants. We represent a variety of clients, including some of Canada's leading shopping centre developers in all aspects of their business, from land acquisition, assembly and redistricting, to planning, tenant mix, leasing, financing and sale. Our work includes leasing activity for the most significant shopping centres in Edmonton, Calgary and other locations in Western Canada. Our proficiency in developing efficient and effective shopping centre leases has earned us a reputation across the nation.

Our representation extends beyond national developers. We regularly advise and assist numerous regional and local developers, landlords and property managers in all aspects of commercial real estate development. This includes the preparation and negotiation of all documentation involved (including offers to lease and formal leases) for shopping centres, office buildings, strip malls and warehouses, as well as the interpretation and application of those documents in various circumstances.

We also represent tenants in lease negotiations for their businesses. Our clientele is diverse, ranging from small local businesses to national tenants with locations across Canada. Our primary goal is to ensure that our clients fully understand all aspects of the lease agreements they are entering into. We strive to make certain that these agreements are suitable and beneficial for their specific business needs.

We routinely address a wide range of commercial leasing issues that impact current business operation and future growth. Our experience spans all aspects related to the drafting, negotiation and enforcement of commercial leases in shopping centre, office and warehouse developments. Clients who typically require these services include those directly affected by leasing issues, such as developers, financial institutions, landlords, property managers and tenants.

Members of our firm actively contribute to the leasing community by lecturing at local, national and international leasing and industry seminars. Many of our lawyers have published articles addressing various aspects of development, planning and leasing.

Our commitment to learning is also reflected in our dedication to staying abreast of industry trends and contributing to the evolution of commercial leasing practices. As part of this commitment, we maintain professional affiliations with the Building Owners Management Association and the International Council of Shopping Centres.
